Acceptance of Agreement

You agree to the terms and conditions outlined in this Agreement with respect to our site (OTON Infinity). This constitutes the entire agreement between you and OTON Industries, superseding prior agreements. This Agreement may be updated at any time without notice. Your continued use of the platform confirms your acceptance of the current Terms of Use.

Copyright

The content, graphics, and design of OTON Infinity are protected under copyright and intellectual property laws. Reproduction or use without prior written permission is prohibited.

Deleting and Modification

We reserve the right to edit or delete content or features on the OTON Infinity platform at our discretion, including this Agreement, without notice.

The OTON Hardware Path Program

This section governs the "Hardware Path" program for subscribers of the "Architect Tier" and above.

As an Architect Tier subscriber, 100% of your net subscription fees will be accrued as "Hardware Credit." This credit is automatically applied as a discount towards the purchase of the OTON INFINITY X physical unit.

Your Hardware Credit is non-refundable but will never expire. In the unlikely event that the OTON INFINITY X physical hardware product is not brought to market for public sale within 36 months of the program's launch, your accrued Hardware Credit will be automatically converted into a credit for 24 months of complimentary OTON OS "Innovator Tier" cloud service access, beginning from the date of the announcement.

Contests, Giveaways, and Promotions

Any contests, giveaways, sweepstakes, or other promotions (collectively, "Promotions") made available through the site may be governed by rules that are separate from these Terms of Use. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply. The following terms apply to all Promotions:

• Eligibility: To enter any Promotion, you must be at least eighteen (18) years of age.
• No Purchase Necessary: No payment, fee, or purchase of any kind is required to enter or win any Promotion. A purchase will not increase your chances of winning.
• Compliance: All Promotions are subject to all applicable federal, state, and local laws and regulations and are void where prohibited.

Indemnification

You agree to indemnify and hold harmless OTON Industries, its staff, and affiliates from any claims or losses resulting from your use of the site or your violation of this Agreement.

Disclaimer

OTON Infinity is provided "as-is" and "as available" without warranties. We are not liable for damages, losses, or errors from using the platform or any third-party services linked to or from the site.

Limits

OTON Industries disclaims liability for any damage caused by viruses or third-party content accessed through the platform.

Third-Party Websites

We are not responsible for the accuracy or policies of third-party sites linked through OTON Infinity. You access them at your own risk.

Third-Party Products and Services

OTON Industries is not liable for products or services offered by third-party vendors. All transactions with third parties are solely between you and them.

Email Communication

By using OTON Infinity, you agree to receive service-related emails and updates. You can opt out of non-essential emails at any time.

General

This Agreement is governed by the laws of the state of Alabama, USA. All disputes must be filed in the courts of Calhoun County, Alabama, or the U.S. District Court for the Central District of Alabama.
